By registering on and/or using the Platform (defined below) You agree to be bound by these terms. Your agreement with us includes these terms and the privacy policy available at Privacy Policy (collectively “Agreement”).

THE SERVICES AND PRODUCTS MADE AVAILABLE ON THE PLATFORM ARE CURRENTLY AVAILABLE IN INDIA ONLY.

IF YOU DONOT AGREE WITH THESE TERMS THEN PLEASE REFRAIN FROM USING THE PLATFORM.

By accessing or using the Platform, You irrevocably accept the Agreement and agree to abide by the same (as updated from time to time).

1. Definitions:

1.1. “User or You” shall mean any person who is browsing the Platform and/or uses the Platform in any manner.

1.2.  “Platform” shall mean the website made available at https://naturessweetness.in.

1.3. “Product” shall mean any the products made available for sale on the Platform.

1.4.  “Order” shall be defined as the process detailed in Clause 9.1 below.

2. General  Disclaimers.

2.1.  NATURE’S SWEETNESS HAS THE RIGHT TO REFUSE REGISTRATION OR CANCEL YOUR ACCOUNT/ ACCEPTED ORDERS IN ITS DISCRETION FOR ANY OR NO REASON WHATSOEVER;

2.2 . WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU SPECIFICALLY ACKNOWLEDGE THAT NATURE’S SWEETNESS HAS THE RIGHT TO TERMINATE OR LIMIT YOUR ACCOUNT/ ACCEPTED ORDERS IN THE EVENT THAT NATURE’S SWEETNESS DETERMINES, IN ITS SOLE DISCRETION, THAT YOU HAVE VIOLATED THESE TERMS OF USE OF NATURE’S SWEETNESS OR ANY FORUM USED BY YOU, INCLUDING BY ACTIVITIES THAT ADVERSELY AFFECT THE EXPERIENCE OF OTHER USERS; THE USER SHALL AGREE THAT ANY VIOLATION OF THE TERMS FROM HIS/ HER END MAY CAUSE IRREPARABLE HARM TO NATURE’S SWEETNESS, FOR WHICH MONETARY DAMAGES MAY BE INADEQUATE AND THE USER SHALL PERMIT NATURE’S SWEETNESS TO OBTAIN ANY INJUNCTIVE OR EQUITABLE RELIEF THAT NATURE’S SWEETNESS DEEMS NECESSARY OR APPROPRIATE IN SUCH CIRCUMSTANCES. THESE REMEDIES ARE IN ADDITION TO ANY OTHER REMEDIES NATURE’S SWEETNESS MAY HAVE AT LAW OR IN EQUITY.

2.3.  NATURE’S SWEETNESS RESERVES THE RIGHT TO CHANGE THESE TERMS FROM TIME TO TIME, AND SUCH CHANGES WILL BECOME APPLICABLE TO YOU IF YOU CONTINUE TO USE THE PLATFORM AT ANY TIME AFTER SUCH CHANGES ARE POSTED ON THE PLATFORM.

2.4. NATURE’S SWEETNESS MAY ASK THE USER TO PROVIDE CERTAIN PERSONAL INFORMATION TO NATURE’S SWEETNESS FOR DELIVERY OF ORDERS PLACED ON THE PLATFORM, AUTHENTICATION AND REGISTRATION PURPOSES. NATURE’S SWEETNESS’S INFORMATION COLLECTION AND USE POLICIES WITH RESPECT TO PRIVACY OF SUCH INFORMATION ARE SET FORTH IN THE PRIVACY POLICY AVAILABLE . THE USER HEREBY CONSENTS, EXPRESSES AND AGREES THAT HE/ SHE HAS READ AND FULLY UNDERSTANDS THE PRIVACY POLICY AND CONSENTS THAT THE TERMS AND CONTENTS OF SUCH PRIVACY POLICY ARE ACCEPTABLE TO HIM/ HER.

3.  Parties to this Agreement.

These terms describe a contractual agreement between You, the User of the Platform, and Nature’s Sweetness and its subsidiaries and affiliates (if any) (collectively “Nature’s Sweetness”, “Us”, “We”, “Our”), regarding Your use of the Platform and the purchase of Products therein.

4.  User Conduct and Rules.

4.1. The User shall not upload, publish, update or share any information that, in the sole discretion of Nature’s Sweetness:

4.1.1.  is in any way grossly racial, harmful, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, racially objectionable, disparaging or otherwise unlawful in any manner;

4.1.2. interferes with or disrupts access to the Platform or servers or networks;

4.1.3. falsifies or deletes any author attributions, legal or other notices or proprietary designations or labels of the origin or source of software or other material on the Platform; and/or

4.1.4. involves an illegal or unauthorised use of copyrights work.

4.2. The User shall not promote or try to gain unauthorised access or exceed the scope of authorised access to the Platform and its connected network.

4.3. The User shall not interfere with another User’s use of the Platform.

4.4. The User shall not attempt or otherwise impersonate another person during the use of the Platform.

4.5. The User shall not use the Platform for any purpose that is unlawful or otherwise prohibited by these terms.

4.6. The User’s ID and password are unique to You, and You agree not to disclose or share Your User ID and password to or with any third party.

4.7. The User shall be solely responsible for the maintenance and security of Your User ID and password. You also agree that You will be solely responsible for any activities, authorised or unauthorised, including Orders placed, payments made and/or breach of any terms of this Agreement conducted on or through Your account whether or not You are the individual who undertakes such activities.

4.8. The User shall release and hold harmless Nature’s Sweetness from any and all claims and cause of action arising out of or resulting from a third party’s unauthorised use of Your Account.

If the User is dissatisfied with the Platform or Products being made available by Nature’s Sweetness, User’s sole remedy is to discontinue using the Platform and/ or Products.

5. User Account, Password and Security.

5.1.  You shall receive a password and account designation upon completing the registration process on the Platform.

5.2. The User shall be solely responsible for the maintenance and security of Your User ID and password. You also agree that You will be solely responsible for any activities, authorised or unauthorised, including Orders placed, payments made and/or breach of any terms of this Agreement conducted on or through Your account whether or not You are the individual who undertakes such activities.

 6. Limited User.

Nature’s Sweetness allows the user to browse the Platform and make purchases ONLY FOR PERSONAL USE. The User shall not purchase any Products for commercial purposes.

7. Product Description.

Product description provided for any and all of the Products or other content made available on the Platform is for reference purpose only and may contain unintended inaccuracies. You may write to us at support@naturessweetness.in if you identify a stark difference between the description and the product and we shall put in our best possible efforts to rectify the same.

8. Pricing 

All Product prices indicated on the Platform are in INR and inclusive of all taxes. Product availability and price is subject to change without prior notice by Nature’s Sweetness.

9. Order Process.

9.1.The Order for purchase of a Product available for sale on the Platform shall be deemed to have been successfully placed on completion of the following process:

i)  The User selects the Product(s) that he/she wishes to purchase and places it in his cart;

ii) The User select the quantity of selected Product(s);

ii) Before validating the Order, the User accepts the terms of use concerning the sale of such Product,

iv) The User provides the delivery Address, billing address and contact details required to contact the User for delivery;

v) The User selects the preferred payment method from the available options;

vi) The payment for the required amount is processed and has been irrevocably credited in the intended account;

vii) A receipt of confirmation of Order is received by the User by way of e-mail on the registered email ID or an SMS on the  registered mobile number.

9.2. Any cancellations or refunds shall be addressed in accordance with the Cancellation and Refund Policy of Nature’s Sweetness made available at Return and Refund Policy

10. Payment Mechanism.

10.1. Purchase of Products by placing an Order with Nature’s Sweetness shall be completed by payment methods provided on the Platform. Payments can be made via Credit Card/Debit Card/Net Banking/UPI/Cash On Delivery.

10.2. The User shall ensure his compliance with the terms and conditions of any third-party service provider facilitating payments for placing Orders on the Platform. Nature’s Sweetness shall not be liable for any issues regarding payments/refunds and the same shall be addressed with the relevant service provider in accordance with their terms and conditions.

10.3. Nature’s Sweetness reserves the right to change the accepted methods of payment at its sole discretion.

10.4. Nature’s Sweetness does not warrant that all methods of payment are available at all times.

11. Feedback Mechanism.

The User may write to support@naturessweetness.in for any feedback or queries that he/she may have concerning the Platform, or the Products made available thereon.

12. Shipping and Delivery.

Nature’s Sweetness will only process any Order place subject to payment for the Product purchased being completed and further subject to the following conditions:

i) Nature’s Sweetness will make the sincerest efforts to deliver the Product as per the Order placed by the User. Delivery periods  mentioned at the time of ordering are approximate and may vary. While We take great care to ensure timely delivery, We take no responsibility for late delivery and for any loss incurred by You due to any delay in delivery of the Product.

ii) In case of late delivery, the delivery charges and/ or payment for the Order will not be refunded.

iii) The title and risk of the Product shall pass onto You from Nature’s Sweetness through its delivery personnel upon delivering the Order to You and You accepting the delivery of the Order/ Product.

It must be noted that delivery for some or all Products may not be available to certain locations. If that is the case, Nature’s Sweetness shall inform you about the same using the contact details shared by you while placing the Order and arrange for cancellation of the Order placed or delivery to an alternative delivery address.

13. Warranties and Limitation of Liability.

 13.1. Nature’s Sweetness disclaims any and all warranties of any kind either expressed or implied, on all Products offered on the  Platform or otherwise to its fullest extent.

 13.2. Nature’s Sweetness disclaims any and all warranties of any kind either expressed or implied on supply of Products and delivery to its fullest extent permissible under Applicable Law. If We are found liable for any loss or damage to You such liability is limited to the amount you have paid for the relevant Products and/or delivery of such Products.
13.3. Nature’s Sweetness shall not be liable for any failure or delay in delivering the Products where such failure or delay arises as  a result of any act or omission, which is outside our reasonable control.

13.4.  Nature’s Sweetness shall not be liable for any person believing any other company misrepresenting Nature’s Sweetness and the losses incurred by such person due to such belief.

14.  Indemnity.

The User(s) shall indemnify, defend and hold harmless Nature’s Sweetness and its affiliates, if any, from and against any and all losses, liabilities, claims, suits, proceedings, penalties, interests, damages, demands, costs and expenses (including legal and statutory fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Nature’s Sweetness that arise out of, result from, or in connection with:

i) the User’s breach of these terms;

ii) any claims made by any third party due to, or arising out of, or in connection with Your use of NATURE’S SWEETNESS Platform;

iii) The User’s violation of any rights of another, including intellectual property rights; and

iv) The User’s violation of any applicable laws.

15. Severability.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

16. Governing Law.

16.1. These terms shall be governed by the laws of India.

16.2. Any claim or dispute between the User and NATURE’S SWEETNESS shall be entertained and tried solely and exclusively by the Consumer Forum located in New Delhi, India and no other place whatsoever.

17. Waiver

No provision of this Agreement shall be deemed to be waived and no breach excused, unless such waiver or consent shall be in writing and signed by NATURE’S SWEETNESS. Any consent given by NATURE’S SWEETNESS, or a waiver given by NATURE’S SWEETNESS of any breach of terms by the User, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
